BACKGROUND

Carbon Border Adjustment Mechanism is EU regulation aimed at preventing “carbon leakage”

Initially covers specific products in certain carbon-intensive industries: iron and steel, aluminium, fertilisers, cement, hydrogen, electricity; planned scope extensions

Designed to level the playing field for EU producers paying carbon taxes and incentivise non-Eu trading partners to decarbonize

“Preliminary” period starts October 2023

First reporting obligations in January 2024; EU CBAM declarants must file a report based on CBAM structure for all non-EU suppliers / imported goods

“Definite” period starts January 2026: only authorised EU CBAM declarants can import CBAM goods; obligation to buy CBAM certificates linked to carbon footprint (carbon taxes)
